The Advantages of a Class Action or Mass Tort

  • Consolidated resources – One of the greatest advantages of a class action lawsuit or mass tort is that they require less lawyers, investigators, copies of documents, and other resources than would be necessary if every individual filed lawsuits separately.
  • Cost savings – Consolidating resources reduces the cost of litigation. By merging the costs among plaintiffs, one plaintiff does not have to be left with a significant financial burden.
  • A streamlined process – Rather than requiring witnesses to attend multiple depositions and produce the same testimony multiple times, a class action lawsuit or mass tort allows everything to be carried out at once on behalf of each plaintiff.
  • Judgement consistency – There may be conflicting rulings when the same issues are litigated several times in different courts. That being said, class actions lawsuits and mass torts create consistency in judgments.
  • A fair distribution of damages – With a class action lawsuit, all plaintiffs can receive a fair distribution of damages. There are no issues with the potential of a defendant’s financial resources being unfairly distributed on a first-come, first-serve basis.

The 5 Phases of a Class Action

A typical class action lawsuit goes through:

  • Certification- If a case qualifies as a class action lawsuit, it will receive certification.
  • Defining the class- Once a case receives certification, a judge will define the characteristics of the class.
  • Notification- Next, the judge will order that all plaintiffs be notified of the class action. They may be notified by mail, advertisements, and/or television commercials.
  • Opting out Plaintiffs who prefer to file their own lawsuit will be informed that they have the right to opt-out of the class action.
  • Selecting counsel- The judge will then select a counsel for the plaintiffs. They will make sure the counsel has experience with class action lawsuits and can represent the class in a fair manner.
  • Distribution of damages- Lastly, the judge will work with the plaintiffs’ attorney to design a plan for distributing monetary damages to the plaintiffs.

The 5 Phases of Mass Tort Lawsuits

Mass torts will typically involve:

  • Record Review – A mass tort lawyer will check records to see if you have a case. They’ll examine allegations of injuries, medical histories, and pre-existing conditions. A mass tort lawyer will be looking to see if your claims match are consistent with a bad product.
  • Distinguish Injury Uniformity – a lawyer will begin searching for similar claims so they can qualify for a mass tort. They can collect evidence from individuals and build one case against the offender. Each individual will have a different claim, but the lawsuit’s structure will be similar. Victims with different symptoms will be excluded.
  • Filing a Civil Lawsuit – Mass tort lawsuits are filed in state courts. Although plaintiffs can live across the state, they should file together.
  • Bellweather Trials – Before a mass tort lawsuit ensues, lawyers will “test” their cases with bellweather trials. They use the most severe cases to see if they have a winning argument before a mass tort. If these fail, a mass tort probably won’t succeed.
  • Settlement – If a mass tort is settled before going to trial, the defendants will pay a certain amount of money to the plaintiffs in exchange for a dismissal. If the matter goes before a judge or jury, they can rule for the plaintiffs or the defense. If the jury sides with the plaintiffs, the defendants will need to pay damages. Each plaintiff is paid their own compensation, it isn’t split evenly amongst the plaintiffs of the tort.
